SpeedCurve Terms of Service and Privacy Policy

Last Updated: August 7th, 2026

This is a legally binding contract between you and Embrace Mobile, Inc. (aka “Embrace”.) All references to SpeedCurve are as a product wholly owned and operated by Embrace. Please make sure you read it, because it is important. We’ve tried to make it as clear as possible, but we welcome your feedback to [email protected] if you have suggestions or questions.

1. Definitions

We’re going to use some shorthand to make this easier to read. When we say "site," we mean speedcurve.com and the services offered through that site. When we say "we," "us," or "our," we mean Embrace Mobile, Inc. When we say "your content," we mean any text, sound, graphics, or other material which you post, upload, or otherwise share on the site; similarly, when we say "SpeedCurve content," we mean the copyrightable text, sound, graphics, and other material owned by Embrace Mobile, Inc. And when we say "terms," we mean these terms of service.

2. Accepting these terms

Please read these terms before using the site. If you do not agree to these terms, you may not register for the site. If we make material changes to these terms, we’ll let you know either through the site or via email (at the email address you provide). If you do not agree to those changes, you may cancel your account. If we do not hear from you within ten days, the revised terms will apply to you.

3. Privacy policy

When you register with the site, you will be asked to provide certain personal information, including your name, email address, and URLs for your website. We will store your personal information, but will not share it with any third parties, except as necessary to provide the services offered, to monitor usage, and to improve the service. For example, we may store your personal information along with your files and data on a third party server such as Amazon Web Services; or we may use a third party analytics tool like Google Analytics to learn how you are using SpeedCurve, and how we can improve that experience. We also use your personal information to send you notifications about the service and to respond to customer support requests.

We will never share your personal information with advertisers or send you promotions for unrelated services.

We will also aggregate user information and perform statistical analyses of the collective behavior of our members and visitors, to measure overall demographics, and to analyze how to improve our service. We may share this information with third parties (such as Google Analytics), but such aggregate information does not contain personal information. In addition, we may compile and disclose aggregate information about our users for promotional or other purposes. For example, we might want to disclose that a certain percentage of our users are located within a particular geographic area or work most frequently in the mornings.

We use session and login cookies, which help us keep track of when a person is logged in and determine the content and features people use. We will also capture login timestamps, and usage statistics.

We will communicate with you via email, to the email address you provide to us. Some communications, such as emails informing you of new features, may be unsubscribed to via the unsubscribe link in the email. If you would like to cease all communications from us, please send an email to [email protected]

4. Confidentiality and security

4.1 Except as permitted by clause 4.3, neither party will disclose the other party's Confidential Information to any person, or use such Confidential Information for any purpose other than to perform its obligations under these Terms.

4.2 We use reasonable efforts to keep your confidential information secure, through technical and organisational measures, including measures designed to encrypt your Confidential Information in transit.

4.3 Notwithstanding clause 4.1, either party may disclose any of the other party's Confidential Information with the other party's prior written consent or if and to the extent disclosure is required by law (provided that the disclosing party gives the other party notice of the requirement as soon as practicable before such disclosure is made).

4.4 In this clause 4, 'Confidential Information' means information disclosed or made available by a party under this Agreement that is marked as confidential or which, given the nature of the information and the circumstances surrounding its disclosure, would reasonably be understood to be confidential in nature. Confidential Information does not include information that: (a) is or becomes publicly available through no fault of the receiving party; (b) was rightfully in the receiving party's possession prior to disclosure by the disclosing party; (c) is independently developed by the receiving party without use of or reference to the disclosing party's Confidential Information; or (d) is rightfully obtained by the receiving party from a third party without restriction on disclosure or obligation of confidentiality.

4.5 You agree that we may use your name and logo to identify you as a SpeedCurve customer on our website, in marketing materials, and in business development presentations. You agree to act as a reference for us upon reasonable request. You may withdraw consent to such use upon thirty (30) days’ prior written notice to the other party.

5. Copyright and intellectual property

We own our stuff; you own yours.

We own the SpeedCurve platform, the SpeedCurve content, the site, and all intellectual property rights therein. You retain ownership of all content you post, upload to, or otherwise share on the site. However, by posting, uploading, or sharing your content, you grant us a non-exclusive, sub-licensable, royalty-free, worldwide license to access, use, and display your content in connection with the site and services we provide to you. This license permits us to perform the services that you registered for; for example, it permits us to store your content on redundant data servers, but it does not permit us to sell your content to advertisers or any other third party, nor does it transfer the copyright to us. This license ends when you delete the material or your account.

Notwithstanding anything to the contrary, Embrace and its licensors exclusively own and retain all right, title and interest in and to the SpeedCurve platform, the site, and all technology, software and intellectual property rights related thereto, and improvements, modifications, enhancements and derivatives thereof. The SpeedCurve platform is protected by applicable intellectual property laws, including U.S. copyright law and international treaties.

“SpeedCurve,” the SpeedCurve logo, “Embrace,” the Embrace logo, and any other product or service name or slogan displayed on the SpeedCurve platform or site are trademarks of Embrace Mobile, Inc. or its affiliates, and its and their suppliers or licensors, and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Embrace or the applicable trademark holder.

If you provide us with any suggestions, ideas, enhancement requests, recommendations, or other feedback relating to the SpeedCurve platform or the site (“Feedback”), you hereby grant us a royalty-free, worldwide, transferable, sublicensable, irrevocable, perpetual license to use, reproduce, modify, create derivative works from, distribute, and display such Feedback in any manner and for any purpose, without any obligation or compensation to you. You acknowledge that we may use Feedback at our discretion and are under no obligation to implement any Feedback.

15. General

Enforcement of any dispute relating to this agreement will be governed by the laws of the State of California, excluding its conflict and choice of law principles. For parties residing in the United States, the exclusive jurisdiction and venue for any claims arising out of or related to this Agreement or your use of SpeedCurve is in the state and federal courts located in City and County of Los Angeles, California, and you irrevocably agree to submit to the jurisdiction of such courts. Embrace’s failure to enforce any right or provision in this agreement will not constitute a waiver of such right or provision unless acknowledged and agreed to by Embrace in writing. In the event that a court of competent jurisdiction finds any provision of this agreement to be illegal, invalid, or unenforceable, the remaining provisions will remain in full force and effect. The terms and conditions which by their nature are intended to survive termination of this agreement shall survive, including Restrictions, Disclaimer of Warranties, Indemnity, and Limitation of Liability. If you are a U.S. federal government department or agency or contracting on behalf of such department or agency, SpeedCurve is a “Commercial Item” as that term is defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation,” as those terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, SpeedCurve is licensed to you with only those rights as provided under the terms and conditions of this agreement. You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services. You agree that you will not export or re-export the SpeedCurve platform or any part thereof, or any technical information related thereto, in violation of any United States export control laws or regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control, and the International Traffic in Arms Regulations maintained by the Department of State.

This agreement, and all subsequent renewals, are subject to the terms and conditions of Embrace’s standard Terms of Service (“TOS”), “Privacy Policy” and Data Processing Addendum (“DPA”) (collectively, the “Standard Terms”); provided, however, that in the event of a conflict between the Standard Terms and this agreement, those aforementioned agreements shall control.
