Warranties<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Each of us warrants that it has full power and authority to enter into these Terms and to perform its obligations under it. In addition, we warrant that we will use reasonable skill and care in performing the services, that we&#8217;ll use commercially reasonable efforts to prevent interruptions to the service, and that we&#8217;ll be good stewards of your data. If there is a breach of any of those warranties, then our sole obligation is (at our obligation) to re-perform the service or refund to you the fees you&#8217;ve paid for the affected the service.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In all other respects, the site and our services are provided on an &#8220;as is&#8221; and &#8220;as available&#8221; basis. We disclaim all other warranties of any kind, whether express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not make any warranty that the site or our services will meet your requirements, or that the services will be uninterrupted, timely, secure, or error free, or that defects, if any, will be corrected. You understand that you download from or otherwise obtain content or services through the site at your own discretion and risk.<\/span><\/p>\n<h2><\/h2>\n<h2><b>8. Limitations of liability<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Subject to the remainder of this clause 7, maximum aggregate liability under or in connection with these Terms or the Service, whether arising in contract, tort (including negligence) or otherwise, shall in no event exceed the amount equal to the fees paid or payable by you to us in respect of our services in a six (6) month period. However, we will not be liable for any indirect, consequential or special loss or damage, or for any loss of profit, loss of revenue, loss of or damage to data, or damage to goodwill or reputation. The foregoing shall not apply to the extent prohibited by applicable law.<\/span><\/p>\n<h2><b>9. Right to terminate<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">We may at any time decide to alter, amend, modify, or terminate the site, any functionality or portion of it, all in our sole discretion, and you understand that there is no guarantee that the site or any portion or functionality of it will continue to operate or be available for any particular period of time.<\/span><\/p>\n<h2><\/h2>\n<ol start=\"10\">\n<li><b> Cancelling your account<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">You can cancel your account at any time.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you&#8217;re a Pay-As-You-Go customer,<\/span><a href=\"http:\/\/support.speedcurve.com\/billing\/viewing-invoices-and-changing-payment-details-for-pay-as-you-go\"> <span style=\"font-weight: 400;\">cancel your account through your billing portal.<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400;\">If you&#8217;re an Enterprise customer, send an email to speedcurve@domore.co.jp. Note that SpeedCurve does not issue refunds after 30 days. (See below.)<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Upon cancelling your account, your files will be marked for deletion in 60 days, and will be deleted upon expiration of that 60-day period.<\/span><\/p>\n<ol start=\"11\">\n<li><b> 30-day refund<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">If for any reason you&#8217;re not happy with your monitoring during the first 30 days of your subscription, we will provide a no-questions-asked full refund. Just email speedcurve@domore.co.jp with your account details within the first 30 days and request a refund.<\/span><\/p>\n<ol start=\"12\">\n<li><b> Billing statements<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">The name that will appear on your billing statements with be &#8220;SpeedCurve&#8221; or &#8220;SpeedCurve Limited&#8221;.<\/span><\/p>\n<h2><b>13.
